Personal claims coming from traffic accidents is another report by the European Insuralex group. Lawyers from several European countries have compared the different legal systems for personal claims from traffic accidents. Lawyers from Spain, France, Bosnia & Herzegovina, Greece, Austria, Poland and UK describe legal regulations existing in their jurisdictions in the area of personal claims.
Much has been written about the types of personal claims from traffic accidents (but not only as medical claims and the like will also be involved). Drawing on the experience of members of the European Insuralex group, we present a new European report on personal injury. We have analyzed the types of claims available in the various European legal regimes, the range of persons who can bring them before the ordinary courts, the legal elements of these claims, their limitation periods and the amounts and rules of damages adjudication by the courts. We have based our data on analyses of the most recent case law in each country and actual legal regulations. With the dynamically changing reality, new challenges in the area of road traffic protection and the need to adapt insurance products to the modern world, it is necessary to constantly observe what other legal orders provide for and how claims in this area are dealt with by the courts. This is particularly important when it comes to the settlement of international claims.
