DATA PROTECTION POLICY

1. BASIC INFORMATION ON DATA PROTECTION

DATA CONTROLLER: INSURALEX

PURPOSE: To attend to requests of various kinds by the Data Subject.

LEGITIMATION: Consent by the Data Subject.

RECIPIENTS:Other companies that belong to the INSURALEX group; government and public bodies in order to meet the obligations that INSURALEX has to comply with.

2. DETAILED INFORMATION ABOUT DATA PROTECTION

This Data Protection Policy governs the processing of the personal data supplied by the Data Subject via the Internet portal (hereinafter, the “Portal”) that INSURALEX makes available to Internet users. This Policy is an integral part of the Legal Notice that can be accessed on the Portal at any time.

The Data Subject guarantees that the information provided is true, accurate, complete and up-to-date, and is responsible for any direct or indirect loss or damage that may be caused as a result of the breach of said obligation. If the data provided pertains to a third party, the Data Subject guarantees that they have informed said third party of the aspects contained in this document and obtained the latter’s authorisation to supply INSURALEX with their data for the purposes indicated.

The Portal can offer functionalities for sharing content via third-party applications, such as Facebook or Twitter. These applications can collect and process information related with the user's browsing on different websites. Any personal information collected by these applications can be used by third-party users thereof, and their interactions are subject to the privacy policies of the companies that provide the applications.

The Portal can host blogs, forums, and other applications or social network services in order to facilitate the exchange of knowledge and content. Any personal information that is provided by the user may be shared with other users of that service, over which INSURALEX has no control whatsoever.

In order to offer information or services of interest based on the location of the Data Subject, INSURALEX may access data related to the geolocation of the latter’s device, in those cases in which this is permitted by the user's configuration.

For purposes of technical security and system diagnosis, anonymous or aggregated, INSURALEX may record the IP address (identification number of the device’s Internet access, which allows devices, systems and servers to recognise and communicate with each other). This information may also be used for analytical purposes concerning web performance.

PURPOSE OF PROCESSING:

INSURALEX processes the information supplied by the Data Subject in order to attend to the requests of various kinds made by the latter. Depending on the nature of the request, the purpose will be to deal with (i) queries and requests for proposals, sent via the contact form enabled for this purpose, (ii) CVs sent via the contact form, (iii) subscription to the newsletter service (new developments and legal news), (iv) electronic communications of an informative nature, based on the interests of the Data Subject. INSURALEX may prepare a commercial profile based on the information supplied. No automated decisions will be taken on the basis of said profile.

PROCESSING DATA IN THE CASE OF SENDING COMMUNICATIONS:

The data used, or provided, in informative and/or promotional communications are processed by INSURALEX for purposes consistent with sending electronic information and communications about INSURALEX services, activities, publications, celebrations, congratulations and social and professional events or those relating to other companies belonging to the INSURALEX group in the legal and/or legal advice sector.

Consent for receiving said communications may be revoked at any time in any of the communications received by using the mechanism enabled for this purpose.

The criterion for preserving data shall be dependent on your declaration stating that you do not wish the data to be processed. In any case, the right to access, rectify, delete, object, restriction of processing and request portability may be exercised by sending an email to webmaster@insuralex.com

TIME LIMIT FOR THE PRESERVATION OF PERSONAL DATA:

In general, the personal data provided will be kept for the time necessary to deal with the Data Subject’s request or until the Data Subject requests its deletion. In the specific case of CVs, the data will be kept for a maximum of one year, unless otherwise indicated by the Data Subject.

LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA:

The legal basis for processing the data is legitimation by consent of the Data Subject.

CATEGORIES OF RECIPIENTS:

In cases in which Data Subjects ask for service proposals or send CVs via the Internet, their data may be supplied to other companies belonging to the INSURALEX group in the legal services and/or the legal advice sector.

Likewise, the data may be sent to government and public bodies in order to comply with obligations directly imposed on INSURALEX.

THE RIGHTS OF THE DATE SUBJECT:

Data Subjects have the right to obtain confirmation of whether INSURALEX is processing personal data relating to them, and to access their personal data, request rectification of inaccurate data or, where applicable, ask for it to be deleted when, amongst other reasons, the data is no longer needed for the purposes for which were collected.

In certain circumstances, the Data Subject may request the restriction of the processing of their data, in which case they will only be kept for lodging or defending claims.

In certain circumstances and for reasons related to their particular situation, the Data Subject may object to their data being processed. INSURALEX will cease to process the data, except for compelling legitimate reasons, or to lodge or defend possible claims.

In certain circumstances, the Data Subject may request the portability of their data. If you want your data to be processed by another firm, INSURALEX will facilitate the portability of your data to the new data controller whenever possible.
